New US Visa rules for H-1B Visa is implemented from January 17, 2025. The new set of US Visa rules will bring significant changes to the USA visa application process to hire global talent in the USA. US Department of Homeland Security (DHS) announced major changes to the H-1B visa on December 18, 2024, to address concerns about fraud by employers, employees and other organizations.
The New H1-B visa policy is expected to bring transparency, efficiency and flexibility to the H-1B visa application. The new set of H-1B visa rules will make it easier for employers to retain their skilled employees and eventually benefit the employer-employee relationship. The digitisation of the H-1B Visa application process is also announced. Here are the key updates in the H1-B visa policy.
The key changes introduced in the US H-1B visa include a revised ‘Specialty occupation’ definition, a fairer lottery process, faster H-1B visa processing timelines, and rescheduling flexibility, among others.
According to the United States Citizenship and Immigration Services (USCIS), “The H-1B final rule modernizes the H-1B program by streamlining the approval process, increasing its flexibility to better allow employers to retain talented workers, and improving the integrity and oversight of the program.”
USCIS has also published a revised Form I-129 on January 17, 2025, with no grace period to the transition of the new form. Any petition with the previous April 1, 2024 form will be rejected. Form I-129 is a Petition for a Nonimmigrant Worker filled out by employers or prospective employers.

Visa applicants will now get more flexibility in rescheduling their USA visa appointments, wherein they can reschedule their visa appointment process for free once. USCIS has announced that it will expedite the processing of H-1B extension applications. This change aims to reduce delays for both workers and employers.
The new USA visa rules 2025 redefine ‘Specialty occupation'. The US Department of Homeland Security (DHS) clarifies that now applicants need to prove a logical connection between their educational degrees and the job role they are applying for. Proving a necessary logical connection between the degree and the job responsibilities is mandatory to offer an H1B sponsorship to a foreign worker.
The fairer lottery process will also be implemented as the new H-1B visa rules. This move will curb the bulk of applications from the organisations and ensure a transparent and equitable US visa process.
In order to confirm the legitimacy of the H-1B visa, The Department of Homeland Security (DHS) has introduced the verification of the work site, remote locations and any third-party sites. This verification process is important for eligible and skilled labourers and prevents fraud applications. The failure in the verification process will lead to the rejection of H-1B visa applications. As per the latest guidelines, employers also need to confirm that the registered worker complies with the Labor Condition Application (LCA) rules and regulations.
The new visa rules also announced some changes for Entrepreneurs. As per the new guidelines, entrepreneurs who own a majority stake in their company can now self-petition for H-1B visas. They need to meet stricter conditions for self-petition of H-1B visa.
The new H1-B visa changes will allow visa holders to renew their US visas within the United States, eliminating the need to travel back to their home country. The move will greatly benefit the global workforce working in the United States.

My suggestion is to choose your research focus and write academic papers.
