Advantages of Shifting from an H1B Visa to B1 Visa in USA

An H1B visa allows US companies to hire foreign workers with at least a bachelor's degree in speciality occupations temporarily. On the other hand, a B1 visa allows foreign nationals to enter US for a short term for specific business such as consultations or contract negotiations. Anirudhha, through his story told about various perks he enjoyed after shifting from H1B to B1 visa. These include the following:

  • He now legally runs his own LLC without fear of visa restrictions.

  • He can travel to the US twice a year from India. He is not restricted on travel anymore.

  • His B1 visa has a 10-year validity. He is now free from H1B renewals every few years.

  • He claims that he is no longer stressed about the change in US policies by Trump. The latest US updates are mainly for H1B workers and not for B1 visa holders.

It is crucial to understand for prospects that B1 visa in USA also has disadvantages. Hence, it is not a perfect option for all H1B workers in USA. The B1 visa does not permit you to work in the USA, and you cannot earn US wage income.

As per Anirudhha's story, that means his US LLC must be structured carefully (e.g. contracts, remote services), without violating labour laws in US. Some social media users have already questioned this: ‘How can you run a business in the U.S. on a B‑1 visa?’. Still there is no answer to this, just the planned management without breaking the labour rules is how they can do business in US.

His timing of converting H1B visa to B1 visa is also critical in this case. Trump has just imposed a H1B application fee of $100,000, making the H1B route riskier for many. Analysts estimate this hike could hit Indian professionals disproportionately, since Indians represent nearly 70% of H1B holders in US tech.
